Double Holo Terms of Service

Agreement to Terms

By using the Double Holo website (including all related sites, services, and mobile applications, collectively "Double Holo" or the "Platform"), which is operated by Double Holo LLC, you agree to be bound by all the terms and conditions set forth in this Terms of Service ("Terms"). These Terms apply to all users of the Platform, including without limitation buyers, sellers, and traders of Pokémon cards or other collectibles.

If you do not agree with these Terms, you must not use the Platform. We may update or modify these Terms from time to time by posting the updated terms on our site (with the "Updated" date above). Your continued use of Double Holo after any changes constitutes your acceptance of the revised Terms, so please review them periodically.

Your Privacy

Protecting your privacy is important to us. Please review our Privacy Policy (available on our site) to understand how we collect, use, and safeguard your personal information. The Privacy Policy is incorporated into these Terms by reference. By using Double Holo, you consent to the collection and use of information as described in the Privacy Policy.

Eligibility and Account Registration

Age Requirement

You must be at least 18 years old to buy, sell, or trade on Double Holo. Double Holo is intended only for users in the United States at this time – you must reside in the U.S. and have a U.S. shipping address to engage in transactions. If you are under 18 but at least 13 years old, you may use the Platform only under the supervision of a parent or legal guardian who consents to these Terms. Children under 13 are not permitted to use Double Holo. The parent or guardian of a minor is responsible for the minor's activities on the Platform.

Account Information

You agree to provide truthful, current, and complete information when creating an account on Double Holo and when using the Platform. It is prohibited to use false information, impersonate any person or entity, or create an account for anyone other than yourself. You must choose an appropriate username and/or store name that is not offensive, vulgar, or infringing on someone else's intellectual property or rights.

Account Security

You are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password. If you believe your account has been compromised or used without authorization, you must notify Double Holo immediately.

Account Use and Legal Compliance

By using Double Holo, you represent and warrant that your use of the Platform will comply with all applicable laws and regulations. You agree that you will not use our Platform for any unlawful or fraudulent purposes. This includes, but is not limited to, refraining from engaging in theft, fraud, money laundering, the sale of stolen or counterfeit items, harassment or threats, or any other illegal activities through Double Holo.

Anti-Counterfeiting & Authenticity Compliance

Authenticity Requirements

Double Holo permits ONLY genuine, authentic Pokémon cards manufactured by official licensees of The Pokémon Company International. This includes cards produced by Wizards of the Coast (1999-2003) and The Pokémon Company International (2003-present).

The following are strictly prohibited on our Platform:

• Counterfeit cards - Any fake or reproduction cards attempting to replicate genuine Pokémon cards
• Replica cards - Any unofficial reproductions, regardless of quality or disclosure
• Proxy cards - Custom-made cards for gameplay that resemble official cards
• Unlicensed merchandise - Any Pokémon-related products not officially licensed
• Modified cards - Genuine cards that have been altered to misrepresent their condition or characteristics
• Custom/Fan-made cards - Any non-official cards, even if clearly marked as custom

Enforcement & Investigation

Double Holo actively enforces anti-counterfeiting measures through:

• Proactive monitoring - We regularly review listings for suspicious items
• User reporting system - All users can report suspected counterfeit items
• Investigation process - We investigate all reports of counterfeit items thoroughly
• Expert verification - We may consult authentication experts for high-value items
• Immediate removal - Confirmed counterfeit listings are removed immediately
• Account suspension - Sellers of counterfeit items face immediate account suspension

Seller Obligations

All sellers on Double Holo must:

• Guarantee authenticity - Only list 100% authentic Pokémon cards
• Provide accurate descriptions - Clearly and accurately describe all items, including any defects
• Include clear photos - Provide high-quality images showing the actual item being sold
• Disclose all information - Reveal any repairs, alterations, or unusual characteristics
• Maintain documentation - Keep proof of authenticity for high-value items when available
• Cooperate with investigations - Respond promptly to authenticity inquiries

Cooperation with Authorities

Double Holo fully cooperates with intellectual property rights holders and law enforcement agencies:

• We respond promptly to verified infringement claims from The Pokémon Company International and other rights holders
• We provide information to law enforcement agencies investigating counterfeit operations as required by law
• We maintain records of suspended accounts and may share information to prevent repeat offenses
• We reserve the right to report criminal counterfeiting activity to appropriate authorities

Buyer Protection

If you receive an item you believe is counterfeit:

1. Do not return the item to the seller immediately
2. Contact Double Holo support within 14 days of delivery
3. Provide clear photos and evidence of the suspected counterfeit
4. We will investigate and, if confirmed counterfeit, provide a full refund
5. The seller will face account suspension and potential legal action

Legal Consequences

Selling counterfeit items is not only a violation of our Terms of Service but also:

• A federal crime under U.S. trademark and copyright laws
• Subject to civil lawsuits from intellectual property owners
• Punishable by fines and potential imprisonment
• May result in seizure of counterfeit goods and assets

Products, Listings, and Pricing

Accuracy of Listings

Double Holo is a peer-to-peer marketplace for Pokémon® cards and related collectibles. Sellers are responsible for the accuracy of their listings, including the product title, description, condition, authenticity, quantity, photos, and price of each item. Double Holo strives to keep the Platform's information as accurate and up-to-date as possible, but we do not guarantee that any product listing, price, description, or other content is error-free, complete, or current.

Not as Described

If you purchase an item and find that it is not as described in the listing (for example, you receive the wrong item, the condition is substantially worse than stated, or the item is inauthentic), your sole remedy is to report the issue to Double Holo's Customer Support and follow our Return/Refund process. All claims for items not as described, missing, or damaged in transit must be submitted within 14 days of delivery, or within 14 days of the expected delivery date if the item never arrived.

Pricing and Fees

Prices for products are set by individual sellers (or agreed between traders in a trade) and are listed in U.S. dollars. Unless otherwise noted, the price of an item does not include shipping charges, taxes, or payment processing fees. Double Holo currently charges a marketplace commission fee of 6.9% with a $1.50 minimum to the seller on each completed sale of an item (one of the lowest fees in the industry). This means sellers pay whichever is greater: 6.9% of the sale price or $1.50.

Product Condition and Authenticity

Sellers must accurately represent the condition of items (e.g., Mint, Near Mint, Light Play, etc.) according to any condition guidelines provided by Double Holo. All items offered for sale or trade must be 100% authentic, genuine Pokémon cards as outlined in our Anti-Counterfeiting & Authenticity Compliance section above. The sale or trade of counterfeit cards, replica cards, proxy cards, fake merchandise, unlicensed products, or any item that infringes intellectual property rights is strictly prohibited and will result in immediate account suspension.

By listing an item on Double Holo, you certify that:

• The item is 100% authentic and genuine
• You have the legal right to sell the item
• Your description and photos accurately represent the actual item
• You will cooperate with any authenticity verification requests

Marketplace Transaction Types

A. Fixed-Price Sales

Most items on Double Holo can be purchased at a fixed price set by the seller. When you purchase an item at the listed price, you are entering into a binding contract to pay for that item. Sellers must not list items that they do not have in their possession or that they are not prepared to ship promptly.

B. Bid/Ask Marketplace

Double Holo provides a bid/ask trading system for certain products, allowing users to place binding offers to buy or sell at specified prices. This system functions similar to a stock exchange order book. Bids and Asks are binding commitments, and automatic matching creates instant transactions.

C. Auctions

Double Holo allows sellers to list items in a timed auction format. By placing a bid in an auction, you agree to purchase the item at that bid price if you are the highest bidder when the auction ends. Auction bids are binding and cannot be retracted except in very limited circumstances.

D. Trading and Escrow System

Double Holo offers a unique Trade Marketplace with middleman escrow service. Each party in a trade will be charged a Trade Escrow Service Fee calculated as the greater of 2.5% of their item's estimated trade value or a $2.50 minimum per party (or 1.8% with a $1.80 minimum per party for subscribers). This means if you trade an item valued at $50, you pay $2.50 (not $1.25), whereas an item valued at $200 incurs a $5.00 fee. Both parties must ship their items to our middleman service for authentication and verification before items are forwarded to their final destinations. By initiating or accepting a trade, you agree to pay the Trade Escrow Service Fee regardless of whether the trade is completed, canceled, or disputed.

Fees and Subscription Membership

Subscription Membership

Double Holo offers an optional membership program for $4.99 per month. Subscribers receive:

• Reduced Trade Escrow Fee (1.8% with $1.80 minimum instead of 2.5% with $2.50 minimum)
• Early access to new features
• Promotional discounts on marketplace fees
• Other exclusive perks and benefits

Note on Subscription Billing: Subscription fees are billed monthly and automatically renew unless canceled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Subscription benefits (including reduced trade escrow fees) apply only while your subscription is active.

Shipping Labels and Fulfillment

Integrated Shipping Label Service

Double Holo offers an optional integrated shipping label service that allows sellers to purchase discounted shipping labels directly through the Platform. When you purchase a shipping label through Double Holo (powered by our shipping partner Shippo), you will be charged Double Holo's posted rate for that shipping service.

Mandatory Shipping Requirements by Order Value

To protect both buyers and sellers, Double Holo enforces mandatory shipping requirements based on transaction value:

General Shipping Requirements for All Sellers

Regardless of how you obtain your shipping label (through Double Holo or independently), sellers must:

• Ship items within 3 business days of receiving payment (unless otherwise stated in listing)
• Package items securely to prevent damage during transit
• Use appropriate packaging materials for the item type (card savers, toploaders, bubble mailers, etc.)
• Provide accurate tracking information to buyers (for orders $40+)
• Comply with mandatory insurance and signature requirements for high-value transactions ($500+)
• Ship to the address provided by the buyer through the Platform

Shipping Disputes and Lost Packages

If a package is lost, damaged, or stolen in transit:

• Sellers who purchased labels through Double Holo may file insurance claims directly through the Platform
• For labels purchased independently, sellers must work directly with their chosen carrier
• Buyers should report non-delivery within 14 days of the expected delivery date
• Double Holo will assist in resolving shipping disputes but is not liable for carrier errors, delays, or lost packages
• Sellers remain responsible for ensuring items reach buyers, regardless of carrier issues

Recommendation: For items valued between $100-$500, we strongly recommend (but do not require) purchasing shipping insurance and signature confirmation to protect both parties. Items $500+ automatically require both insurance and signature confirmation as stated above.

Intellectual Property and Site Usage

All content on the Double Holo Platform is the property of Double Holo LLC or its content suppliers and protected by intellectual property laws. "Pokémon" and all Pokémon character names and images are trademarks of Nintendo, Creatures, Game Freak, and The Pokémon Company International. Double Holo is not affiliated with or endorsed by The Pokémon Company International.

When you upload content to Double Holo, you retain ownership but grant us a license to use it in connection with operating and promoting the Platform. You must not post content that infringes any intellectual property rights or violates any laws.

Community Guidelines

Double Holo is more than just a marketplace – it is a community of Pokémon card enthusiasts. We expect all users to interact with each other in a respectful and honest manner. Key principles include:

• Respectful Communication - No hate speech, harassment, or personal attacks
• Relevant Content - Use appropriate channels for your posts
• No Scamming - Never misrepresent what you are offering
• Safe Trading - Always finalize transactions through official Platform tools
• Content Standards - No obscene, pornographic, or offensive material

Risks, Disclaimers, and Limitation of Liability

Double Holo acts as a facilitator between buyers, sellers, and traders. We do not guarantee the authenticity, quality, or legality of items listed. Users assume all risks associated with transactions. Our liability is limited as described in the full Terms above.

Returns, Refunds, and Problem Resolution

Returns are allowed only for specific reasons:

• Item never arrived
• Item arrived damaged in transit
• Item is materially different from listing description
• Item is counterfeit, fake, replica, or not authentic (see Anti-Counterfeiting & Authenticity Compliance section)

All issues must be reported within 14 days of delivery. No "change of mind" returns are allowed. Double Holo will mediate disputes and may require evidence such as photos. False claims may result in account penalties. Making false counterfeit claims is considered fraud and will result in account termination.

Termination of Use

You may terminate your account at any time through account settings. Double Holo reserves the right to suspend or terminate accounts for any reason, including Terms violations, illegal activities, or extended inactivity. Upon termination, you remain responsible for outstanding obligations.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Georgia, USA. Any legal proceedings must be filed in Gwinnett County, Georgia or the Northern District of Georgia. Both parties waive jury trial rights and agree to individual (not class action) proceedings.
